No, 6 of 1970, Cr. R. No, 988 of 1970, Cr. Miscellaneous Nos, 6910 of 1970, 906 of 1970, (2 of 1970) together as they arise from one and the same proceedings in which the subject-matter of dispute and the parties are the same. 2. The proceedings which have given rise to the present litigation between the parties relate to a dispute regarding a godown bearing No, 733-A/732-A situated on City Sadar Road, Rawalpindi. Petitioner Noor Mohammad, who is petitioner in Cr. R. No, 6 of 1970 and Cr. R. No, 988 of 1970, claims to be the owner in possession of the entire godown premises as a result of its acquisition from the Settlement Department under Settlement Scheme No, VIII of the Displaced Persons (Compensation and Rehabilitation) Act, 1958. His case is that the godown in question bears only No, 733-A, whereas No, 732-A relates to another evacuee property which was transferred to one Mirza Muhammad Beg who later sold it to respondent Chiragh Din. His case further is that a dispute arose between the parties regarding a small portion of the shop, which is his godown, as a result of the false claim of respondent Chiragh Din that it was a part of his property.
