The facts of the case, most of which are undisputed, briefly stated are: that the petitioner was appointed a Lower Division Clerk in the War Department of Government of India in Master General of the Ordnance Branch, on 1st November 1941. Shortly thereafter, he was promoted as Section Recorder. At the time of Partition, he opted for Pakistan and resumed duty as Section Recorder in the office of the Chief Administrative Officer, Ministry of Defence, Rawalpindi.
