L J 1080 Result: Order accordingly Judgment ORDER ATTAULLAH SAJJAD J.-Nazar Hussain aged 40, his brother Inayat aged 18 and their two uncle, namely Shera aged 60 and Hussain Muhammad (alia, Hasna) aged 65 have been convicted by laic Sessions Judge, Gujranwala, under section 302/34 of the Pakistan Penal Code for causing the death of their co-villager Farzand Ali. Shera was sentenced to death and the other three convicts were awarded a sentence of transportation for life. The fifth accused, namely, Siraj lain was acquitted. The convicts have filed an appeal against their conviction and sentences. Murder Reference No. 3 of 1969 is also before us for the confirmation of death sentence awarded to Shera appellant. This judgment will dispose of the appeal is well as the murder reference. 2. The occurrence took place in village Noorpur, which is in the jurisdiction of Police Station Qila Didar Singh, in Gujran--wala District on 11th of November 1966, at about Peshiwela. Farzand Ali deceased was a Rajput and a Zamindar of the village. The appellants are K unbars and worked as carriers for the Zamindars who wanted to transport their crops to the market.
