These ill- feelings errupted into the incident of 20th January 1971, which resulted in the censor of work on that day. This censor of work continued up to 25th January 1971. The parties appeared before the Assistant Commissioner and Sub-Divisional Magistrate, Harbour Karachi and a decision was arrived at between the parties in terms of which the workmen agreed to resume work without any condition. According to the applicants when the workmen went to report for duty on 27th January 1971, the Management, refused to allow them to work unless they tendered apology in writing. The workmen brought this position to the notice of the S. D. M., Harbour. Thus according to the applicants the respondent-Management prevented the workmen from resuming work unlawfully.
