The award was given on an application under section 38 of the West Pakistan Industrial Disputes Ordinance, 1968 (hereinafter called the repealed Ordinance). The facts giving rise to the appeal briefly put are these. 2. The appellant was appointed as a Sepoy in the Watch rd. and Ward Department of the Sind Industrial Trading Estates Limited, Karachi. He was called upon to produce satisfactory documentary evidence as to his age. He produced a certificate of the Maulvi and Pesh Imam of Lasbella, which was not accepted by the respondent. The appellant having attained the age of 58 years, he was retired from service on 22nd August 1969, The appellant challenged his retirement on the ground that this involved change of conditions of his service during the pendency of Industrial Dispute No. 19 of 1967. In this connection, he further submitted that he had been made to retire from, service as a result of animosity of Bashir and one Ishaq, who made false reports to Mr. Balooch, who victimised the appellant by calling on him on 31st July 1969 to produce documentary evidence .s to the date…
