J.-These appeals, by special leave, arise out of a judgment of a Division Bench of the erstwhile High Court of West Pakistan, Lahore, whereby 45 appeals under section 8 of the West Pakistan Waqf Properties Ordinance, 1961, were jointly heard and dismissed. These appeals in the High Court arose out of proceedings initiated by the present appellants under section 7 of the West Pakistan Waqf Properties Ordinance, 1959, claiming to be members of the body of Mujawaran of the shrine of Hazrat Data Ganj Bakhsh Sahib of Lahore, for a declaration that certain properties sought to be taken over by the Chief Administrator of Auqafs, West Pakistan, by a notification of the 11th of January 1960, were not Waqf properties or in the alternative were Waqf properties within the limits and subject to the rights of the appellants as claimed by them in their respective petitions. This notification was in the following terms:- "No, 3(1)-Auqaf-60-I, A. H. Qureshi, C. S. P., Administrator of Waqfs, West Pakistan, in exercise of the powers conferred on me by section 6 of the West Pakistan Waqf Properties Ordinance, 1959, hereby take over and assume the administration, control, management and maintenance of the waqf properties attached to the shrine of Hazrat Data Ganj Bakhsh Sahib of…
