By this judgment, a division Bench of the Lahore High Court dismissed the appeal filed by the appellant and confirmed his death sentence. The appellant was tried by the Additional Sessions Judge, Sahiwal, for the murder of Muhammad Sharif Mirasi and was convicted and sentenced to death under section 302, P. P. C. He challenged this order in Criminal Appeal No. 484 of 1969, which, as already stated, was dismissed by the Lahore High Court on the 20th October 1970. The appellant has challenged this judgment in this appeal before us. The prosecution case is that the appellant and the deceased were neighbours living in a locality known as Karbala Road in Sahiwal. It is alleged that the appellant used to tease the grown--up sister of the deceased which led to the quarrel between the parties. The appellant gave beating to the deceased on two occasions.
