J.--This matter has come before us in pursuance to a notice issued by me as the Chief Justice of this Court suo motu directing the Editor, Printer and Publisher and the Staff Reporter of the Daily Nawa-i-Waqt, Lahore, to show cause as to why they should not be punished for contempt of Court under Article 123(2)(6) of the Constitution of 1962 read the paragraph 6(2) of the Provisional Constitution Order, 1969, for publishing a news-item on the first page of its issue of Sunday, the 27th of September 1970, with a bold one inch headline, to the effect that on the instructions of the Law Minister proceedings were likely to be drawn up against six Judges of the High Courts. In the body of the publication, however, it was represented that its staff reporter, Mr. Aizaz Mahmood, had karnt from a reliable source that proceedings have been initiated against six Judges of the High Courts of East and West Pakistan who have already been served with notices thereof and asked either to appear before the Supreme Judicial Council to defend themselves or to tender resignation from their posts.
