L J 33 Result: Appeal partly accepted JUDGMENT JUDGMENT Muhammad Afzal Zullah, J.--Muhammad Raza aged about 16 years has been convicted under section 302, P. P. C. for the murder of Abdur Rahman aged about 35 years and sentenced to death by the Additional Sessions Judge, Lahore, vide his judg ment dated 12th of July 1969. The proceedings are before us under section 374, Cr. P. C. for confirmation of death sentence. The convict has also filed an appeal. Both the matters are being disposed of by this judgment. 2. The facts of the case as disclosed in the statement of Roshan Din (P. W. 7) who is an eye-witness and is also the first informant are as follows :-- Abdur Rahman deceased was the brother of the wife of Roshan Din P. W. Their houses are in front of each other across a lane. The appellant used to reside in the house of his elder brother Muhammad Sabir which is on the Western side of the aforementioned two houses. A small open space (Chowk) inter venes the two houses and the house of the appellant. The appellant used to stand in the chowk in front of the houses of Roshan Din and his brother-in-law.
