Nanji Title: NATIONAL SPINNING MILLS LTD., KARACHI vs EMPLOYEES' UNION Case No.: Date of Judgment:1970-05-28 Reported As: 1970 PLC 655 Result: Orders accordingly Judgment ORDER SHAH NAWAZ KHAN (CHAIRMAN).-The Management of National Spinning Mills Ltd., Karachi, have moved this Court through an application under section 34 of - the Industrial Relations Ordinance, 1969 wherein adjudication of this Court has been sought on some matters in respect of which the Management have claimed that some rights have been secured or guaranteed to them under the Law, as such the respondent-Union namely the National Spinning Mills Employees'. Union, Karachi, cannot raise any dispute, about the same. As the workmen had already gone on strike and the strike was in existence at the time when the aforesaid application under section 34 of the I. 'R. O., 1969 was made to the Court and the same is still continuing, the Management of the aforementioned Mill therefore also moved this Court through the present application under section 45 of the I. R. O., 1969 wherein it has beer; prayed that the Court may prohibit the continuance of the strike. This application has been opposed by the, respondent-- Union.
