L J 975 Result: Rule discharged JUDGMENT JUDGMENT This Rule was obtained by the petitioners against an order dated 20-8-68 passed by Mr. N. N. Bhattacherjee, Magistrate, 1 Class, Bhola dropping the proceedings under section 145, Cr. P. C. The facts leading to the present rule are that on 30-11-66 one Azahar Ali Rari sent an application to the Officer-in-Charge, Charfession Police Out Post alleging that he was in possession of certain lands and that the second party opposite-parties were trying to cut away paddy therefrom. Police submitted report and the learned Magistrate being satisfied from the report that there was apprehension of breach of peace drew up on 2-12-66 a proceeding under section 145 of the Code of Criminal Procedure, attached the lands in question and appointed the Officer-in-Charge of Char-fession Police Out Post as receiver. Both the parties filed written statements and the case was transferred to the Court of Mr. N. N. Bhattacharjee, Magistrate, 1st Class for disposal.
