O R D E R
Adnan-ul-Karim Memon, J. – Petitioner Abida Tarnnum has filed this constitutional petition under Article 199 of the Constitution, seeking proforma promotion to BPS-19 after retirement, revision of pension, and payment of arrears. The question is whether the petitioner was/is eligible for promotion under the Karachi Development Authority Employees Service Regulations, 1973.
As per law the required qualification for BPS -19 (Additional Director) is a Master’s Degree in City & Regional Planning or FMTPI with 13 years’ experience. However, the petitioner holds an M.A. Sociol ogy, which is not the prescribed qualification as asserted by the counsel for KDA Master Plan Department. He submitted that she did not claim promotion during her service and earlier petition filed by her was dismissed as withdrawn. However, the present pe tition is filed after retirement. The department’s counsel stated that they are willing to consider the petitioner’s case and pass a speaking order after providing meaningful hearing to her. At this stage, the petitioner also agreed that this petition may be disposed of with directions to the department to decide her representation. The proposal seems to be reasonable and acceded to.
Without touching the merits of the case, and with the consent of the parties this petition is disposed of with directions t o the petitioner to file a fresh representation within 7 days, with the respondents and the competent authority of respondent department shall pass a speaking order after hearing the petitioner, in accordance with law within two weeks. All pending applications stand disposed of.
