KHAN, J.--This appeal, by special leave, is directed against the judgment and order of a learned Single Judge of the erstwhile High Court of West Pakistan, Lahore Seat, affirming the decision of the District Judge, Lahore, in an appeal arising out of an application for ejectment under section 13 of the West Pakistan Urban Rent Restriction Ordinance, 1959 (Ordinance VI of 1959). Dr. Miss I. All Muhammad, appellant herein, is a private medical practitioner and has her clinic at 67, Nisbet Road, Khan, Lahore. She owns considerable properties in different parts of Lahore, including Shop No, 12/13-A, Shah Alam Market. Muhammad Shafiq, respondent herein, has been in occupation of the said shop as a tenant under the appellant on payment of monthly rental of Rs, 150. On the 17th May 1966, the appellant applied to the Rent Controller under section 13 'of the West Pakistan Urban Rent Restriction Ordinance, 1959 (hereinafter called the Ordinance), for ejectment of the respondent from the aforesaid shop on the ground that she required it in good faith for her own use, namely, to run a second clinic therein.
