Adnan-ul-Karim Memon, J. Petitioner Iqbal Mas ih has filed this Constitutional Petition under Article 199 of the Constitution of the Islamic Republic of Pakistan, 1973 with the following prayer: -

a. To declare that the petitioner is legally entitled for recovery of retirements benefits Gratuity etc from the respondents and the respondents are bound to act under the framework provided in constitution of Pakistan and to obey the law being the statutory body incorporated under the provincial government.

b. To direct the respondents to release retiremen ts benefits etc. forthwith without committing any further delay as the respondents being statutory body is bound to act in accordance with law and recovery of dues is the fundamental right of the petitioner and respondent is bound under principle policy to do so.

2. The petitioner’s wife, Mst. Khalida, was appointed on 12.7.1990 in BPS - 02 in the Solid Waste Management Department, DMC Malir, Karachi, and retired on 30.6.2023. She has not received her pensionary benefits. 3. The respondent/KMC counsel state d that her case will be processed, and benefits are expected to be released within two weeks. the request seems to be reasonable and acceded to. 4. With the consent of the parties, accordingly, the petition along with pending application(s) stands disposed of.
