P. C. for quashing of proceedings initiated against the petitioner and others at the instance of respondent No, 1 briefly are that the petitioner, who is an Assistant Land Superintendent in the employment of the Municipal Corporation, Lahore, alongwith his other co-accused, also employees of the Corporation, visited the complainant-respondent's premises situated outside Bhati Gate, Lahore, where he had stored some earthen pitchers, tents, tables etc. for purposes of sale and hire and allegedly removed some of his articles and also imposed a fine of Rs, 30.00 on his presumably on allegation of encroachment purported to have been removed by them under section 83(2) of the Municipal Administration Ordinance, 1960. Feeling aggrieved the complainant moved the civil Court for contempt of Court on the ground that he was in lawful possession of the land in question on the basis of a decree of the civil Court dated 10-6-1969.
