ORDER Adnan-ul-Karim Memon, J . Petitioners are pre sent in person submit that respondents No.9 to 11 are owners of residential plots/houses situated in Block - 15, F.B. Area, Dastagir, Karachi, where the sanctioned construction is stated to be limited to Ground + Two floors for residential purposes, with the construction permits specifically stipulating that units/flats are not permissible. It is contended that respondents No.9 to 11, in violation of the sanctioned building plans and applicable laws, have allegedly converted the residential premises into mult i- unit/flat-type buildings and, in the case of respondent No.10, have also raised shops on the ground floor. The petitioners assert that such construction is being carried out without requisite approval/NOC and in connivance with the concerned officials. They submit that despite repeated complaints to the competent authorities, effective action has not been taken. It is stated that certain demolition action was initially undertaken by the SBCA pursuant to the complaints, but thereafter the illegal construct ion allegedly resumed. The letter of the Provincial Ombudsman, along with the SBCA's communication dated 23.04.2026, is relied upon to demonstrate that the approved construction was only Ground + Two for residential purposes. 2. Counsel for the SBCA submit that the petitioners are required to approach the SBCA under SCRM and decision shall be made, in accordance with law. 3. Without touching the merits of the case, t he petitioner s are at liberty to approach the SBCA with their complaint by u sing Smart Complaint Redressal Mechanism (SCRM) of the SBCA, who shall decide the same in accordance with its SOPs, after hearing all concerned. 4. The petition stands disposed of in the above terms along with listed / pending application s. A copy of this order shall be sent to DG SBCA for information. JUDGE
