O R D E R
Adnan-ul-Karim Memon, J. – Petitioner Khalida Bibi has invoked the constitutional jurisdiction of this Court under Article 199 of the Constitution of the Islamic Republic of Pakistan, 1973, seeking declaration that she is entitled to the payment of retirement benefits, including gratuity and other allied dues, from the respondents. It is her case tha t the respondents, being a statutory body under the Provincial Government, are under a constitutional and legal obligation to act in accordance with law and release the outstanding dues without further delay. 2. It is further prayed that the respondents ma y be directed to forthwith release all pensionary benefits, including gratuity and other admissible dues, on the ground that the same constitute her fundamental right, and that any other relief deemed just and proper in the circumstances of the case may also be granted. 3. The facts, as stated, reflect that the petitioner’s husband was initially appointed in the Karachi Metropolitan Corporation (KMC) in the year 1989 as a Sanitary Worker in BPS -01. He retired from service on 27.12.2023; however, despite retirement, his pensionary and other service benefits have not been released. 4. Learned counsel representing KMC has, at the time of hearing, submitted that the pensionary benefits of the deceased employee shall be released at the earliest possible time, without unnecessary delay. 5. In view of the above statement and in the interest of expeditious redressal of the grievance of the petitioner, and without touching the merits of the case, and with consent of KMC, the petition is disposed of along with pending applications with a direction to the Karachi Metropolitan Corporation to process and release the pensionary benefits of the petitioner’s husband, if found admissible and outstanding, within a period of three (03) weeks in accordance with law.
