J.--The appellant in these two appeals, who is the same in both these appeals, was at the relevant time employed as an Agricultural Assistant at Hasilpur in the district of Bahawalpur. He was charged for having committed criminal breach of trust and for cheating one Zulfiqar Ali Shah and one Ghulam Mustafa in respect of Rs, 1,000 and Rs, 6,139.78, realised from them respectively on the 17th January 1962, and the 13th February 1962, for the alleged purpose of depositing the same in the local treasury. Two cases were started against the appellant on the com-plaints of the said Zulfiqar Ali Shah and Ghulam Mustafa under section 409/420, P. P. C. and he was tried by the Special Judge, Anti- Corruption, Multan. The appellant admitted the receipt of the above-mentioned amounts. According to him the sum of Rs, 1,000 was paid by Zulfigar Ali Shah towards costs of fertilizers. But he claimed that since the amount could not be spent he had refunded it to the complainant a few days later and obtained a receipt from him.
