B., Tehsil Toba Tek Singh, District Layallpur, was being tried by the learned Sessions Judge of Lyallpur, along with 13 others under section 302/201 read with sections 149 and 148 of the Pakistan Penal Code. Some of the accused in the case were also being tried under the Arms Ordinance. Zulfiqar mentioned above, moved this Court by way of an application (Crl. Misc. No. 4578 of 1969) under section 526 of the Code of Criminal Procedure for the transfer of the aforementioned cases. His petition was not opposed by the learned counsel appearing on behalf of the State and thus it was allowed by me and it was directed that the cases shall be transferred from the Court of the learned Sessions Judge to one of the Additional Sessions Judges, stationed at Lyallpur by order dated 4th November 1969. 2. Aggrieved with the aforesaid order, one Zulfiqar son of Muhammad, resident of Nawab Bhoti, Police Station Peer Mahal, District Lyallpur, has moved this Court under section 561-A of the Code of Criminal Procedure with the request, that the aforementioned order of transfer be recalled and the matter be decided afresh after rehearing the petitioner and the respondents viz.
