Adnan-ul-Karim Memon, J. This petition relates to the alleged illegal confinement of minor Umme-e-Habiba, aged about 4-5 years. 2. None appeared on behalf of the petitioner. 3. Learned AAG submitted that the minor is presently with her mother; therefore, no case for a habeas corpus petition is made out and the matter pertains to custody to be decided by the Family Court. 4. It appears from the record that the petitioner had earlier filed Habeas Corpus Petition No.529 of 2025 before the learned III -Additional Sessions Judge, Malir, Karachi, which was dismissed on 03.11.2025 on the ground that family litigation between the parties regarding custody and maintenance was already pending before the competent Family Courts. 5. In view thereof, the present petition is dismissed for non-prosecution.
