S hama Shoaib has filed this Constitutional Petition under Article 199 of the Constitution of the Islamic Republic of Pakistan, 1973, seeking directions to respondents No.5 and 6 to notify respondent No.2 regarding the revocation and cancellation of her seco nd CNIC No.42101-4514305-7 issued in the name of Shabana Sohail. She also seeks directions for the removal of her name from the blacklist, as the second CNIC has already been revoked/cancelled by respondents No.5 and 6 in accordance with their policy and legal formalities. Counsel for NADRA has submitted that the petitioner held dual CNICs 42201-1048747-6 and 42101 -4514305-2 with different particulars. In 2012, she cancelled CNIC No.42201 -1048747-6 and retained CNIC No. 42101 -4514305-2 (tracking ID No.10318 1051341, Ayesha Manzil), with forms and affidavit attached. The petitioner now holds only CNIC No. 42101 -4514305-2. Other issues fall within the jurisdiction of the civil Courts. The NADRA Law Officer confirmed that CNIC No.42101 -4514305-2 shall be retaine d and forwarded to the competent authority for removal of the petitioner’s name from the blacklist. Learned DAG also sought disposal of this petition in view of the above statement. We have heard the learned counsel for the parties and perused the record with their assistance. The petitioner initially held dual CNICs, but she voluntarily cancelled one (42201-1048747-6) in 2012 and retained only CNIC No.42101 -4514305-2. The second CNIC, which was purportedly issued in the name of Shabana Sohail, has already been revoked/cancelled by respondents No.5 and 6 following all legal

formalities. The remaining CNIC (42101 -4514305-2) is valid and in the petitioner’s possession. Since the revocation of the second CNIC has been properly effected and all necessary legal steps complied with, there is no legal impediment to the petitioner’s name being removed from the blacklist, subject to all just exceptions as provided under the law. Further, issues beyond the issuance and cancellation of CNICs fall within the jurisdictio n of the civil Courts if agitated by the aggrieved party. Accordingly, with the consent of the parties, and without touching its merits, the petition is disposed of with the direction that CNIC No.42101 - 4514305-2 be retained, and the competent authority sh all remove the petitioner’s name from the blacklist if there is no any impediment under the law. However, the aforementioned proposition ensures compliance with NADRA’s policy while upholding the petitioner’s lawful rights. JUDGE
