Barrister Asad Ali, Advocate for the KMC. ********** O R D E R Adnan-ul-Karim Memon, J The petitioner, Sumia , has filed this constitutional petition under Article 199 of the Constitution seeking directions to the respondents to release the retirement benefits, including gratuity and other pensionary dues, of her deceased husband, Nadeem Ahmed, who was appointed as a Sanitary Worker (BPS -02) in the Sanitation Department, TMC Mominabad, Karachi, in 1984 and passed away on 11.05.2024. Despite his death, the pensionary benefits have not been released. 2. During the proceedings, learned counsel for KMC submitted that the respondents are ready and willing to release the petitioner's pensionary benefits within four weeks. A letter dated 13.07.2026 was placed on record, stating that the Government of Sindh is providing Rs. 200 million per month for payment of monthly pensions and that KMC has also requested the Provincial Government to release additional funds amounting to Rs. 9.8626 billion for clearance of outstanding pensionary dues of retired employees of all TMCs. 3. In view of the statement made on behalf of KMC and the assurance regarding payment of the outstanding benefits, learned counsel for the petitioner sought disposal of the petition in the said terms . Accordingly, without touching the merits of the case , the petition is disposed of in terms of the respondents' undertaking. JUDGE JUDGE SHABAN*
