Revision Petition No, 1080 of 1963, were tried by Mr. M. E. Hayat, Additional Sessions Judge, Lahore, at Sheikhupura, along with Noor Muhammad, Hasham and Dilmir under sections 148, 302 read with sections 149 and 323 read with section 149 of the Pakistan Penal Code, for the murder of Ibrahim, father of Abdul Ghafoor petitioner in the aforesaid revision petition and causing simple injuries to Ahmad (P. W. 12) on 12th August 1961, near a culvert, known as Dewasinghwala, situated within the limits of Chak No, 18. The respondents were acquitted, while their aforesaid co-accused were convicted under section 302 read with section 34 of the Pakistan Penal Code. 2. The revision petition was filed by Abdul Ghafoor, son of the deceased, questioning the order of the learned Additional Sessions Judge with respect to the acquittal of the respondents, with a prayer that their acquittal be set aside and retrial ordered. 3.
