NURUL HUDA (CHAIRMAN).-This case arises out of an application under section 25(1)(b) of the East Pakistan Employ--ment of Labour (Standing Orders) Act, 1965. The petitioner Abdul Haque alleges that he was a Bus Driver under the second party, Mr. Sekander Hayat Khan at a monthly salary of Rs. 400.00. He was on continuous service under the second party from 23-7-68 till 18-8-69 when his services were illegally terminated by the second party. He submitted a grievance petition to the second party, but no reply was given to that. It is also said that previously he was also under the service of the second party for some years. The petitioner has prayed for termination benefits as detailed in his application. The second party while admitting that the petitioner was in service contends that he was a casual worker on daily basis wages and that he deserted the service under the second party willingly. In this case we have got to consider, whether the petitioner was a permanent worker as alleged by him and whether he is entitled to any relief in this case.
