07.05.2024. Mr.Javed Hussain Malik, Advocate along with petitioners. Mr. Agha Athar Hussain Pathan, Assistant Advocate General along with SIP Manzoor Ahmed of PS Dad Leghari. M/s Saif-ur-Rehman and Rabia Balouch, Advocates for Respondent No.1. -.-.-.-.-.-.-.-.-.- Petitioner No.1 Mst. Majida Bibi present in person and states that she being Sui Juris contracted valid marriage with petitioner No.2 out of her own free will and consent, which has caused very much annoyance to her family members who are issuing threats of dire consequences. Today, Investigating Officer of Police Station Dad Leghari has recorded her statement in which she states that she has not been abducted by any one and a false FIR No.15 of 2024 registered at P.S Dad Leghari, under Sections 365 -B, 395, 506/2, 114 PPC which is liable to be quashed. Learned AAG Sindh has no objection if the matter is referred to the concerned Magistrate for disposal of said FIR. SIP Manzo or Ahmed Investigating Officer present in Court submits that he will submit summary report to the concerned Magistrate for disposal of the above referred FIR. Order accordingly. In view of the above, this petition having served its purpose is disposed of with direction to the concerned police to provide legal protection to the petitioners as and when they approached for such protection, in the intervening period no harassment shall be caused to the couple. However, respondent No.1 is directed to furnish PR bond in the sum of Rs. 10,00,000/ - (Ten lacs) before Additional Registrar to ensure that he will not cause any loss to the lives of petitioners. Copy of order be provided to learned Additional Advocate General Sindh for compliance.
