The facts briefly put are these. 2. The case of the Union briefly put is that one Habibur Rehman who was a Conductor, was found by Raja Nazeer Ahmad Khan on 11th August 1969, that he had to punched tickets in his rack. Raja Nazeer Ahmad Khan also alleged that Habibur Rehman had misbehaved with him, Habibur Rehman was charge-sheeted or these to counts on 15th August 1969. Muhammad Ilyas held the enquiry against Habibur Rehman the District Manager dismissed Habibur Rehman on 29th November 1969, Habibur Rehman filed an appeal on 5th January 1970, which was dismissed on 5th February 1970, The Union, on 18th February 1970, filed an application under section 34 of the Ordinance giving rise to the present appeal. 3. Th. Main contention of Mr. A.
