However, due to urgency in the matter as shown in the memo of petition, the notice was ordered to be issued, but later on the petitioner and his counsel failed to serve notice upon the respondents and office has fixed this matter for non-prosecution. In view of the above, this Court is left with no option, but to dismiss this lis on account of non-prosecution as the petitioner is no more interested to pursue this case. The petition is accordingly dismissed for non -prosecution alongwith pending application.
