Court Name: Lahore High Court Judge(s): Karam Elahi Chauhan Title: AMANAT ALI vs Syed PANAH ALI SHAH AND ANOTHER Case No.: Writ Petition No. 54 of 1965 Date of Judgment:- Reported As: 1972 PLC 556 Result: Petition dismissed JUDGMENT JUDGMENT Leaving aside the unnecessary details, the facts which are relevant to be mentioned in this case are that the petitioner was a Senior Grade Clerk in the Education Branch of the District Board, Gujranwala in the pay-scale of Rs. 75-6-105/7-175 and was drawing a salary of Rs. 126 p. m. Actually, from April 1960 he was holding the post of an Accounts Clerk/Bill Clerk. On 5-6-1962, was promulgated the West Pakistan Primary Education Ordinance XXIX of 1962 (hereinafter called the Ordinance) for the purpose of consolidating and amending the law relating to primary education in the Province of West Pakistan. As a result of this Ordinance, all primary education was placed under the control of Government and all rights, authority and jurisdiction vested in or exercised by a Local Council In respect of primary education in primary Schools in that area ceased to vest in and be exercisable by the Local Council, and vested in and became exercisable by Government in accordance with the provisions of this Ordinance. As a result of the aforesaid provincialisation of the primary education all teachers and other staff employed by a Local Council in connection with primary education stood transferred for service to and was employed by Government on such…
