L J 49 Result: Rule made absolute Judgment ORDER This Rule is directed against an order dated 31-8-68 passed by the learned Additional Sessions Judge, 3rd Court, Dacca under section 437, Cr. P. C. Directing commitment of the accused-peti-- tioners to the Court of Sessions to face trial under section 148/395, P. P. C. The prosecution case, in short, is that on 9-7-65 at about 3 p.m. The accused Majibur Rahman with others about 200/250 variously armed arrived at the house at 9, Barada Kanta Gangulee Lane, P. S. Kotwali, Dacca. The gate was under lock and key from inside. The accused persons forcibly entered into the premises and some of them went inside the rooms of the ground floor as well as of the first floor, assaulted the inmates of the house including the women, removed trunks, suit-cases etc. Containing cash and gold ornaments and looted away various property worth Rs. 10,000 to Rs. 12,000. The local police was informed over the phone and the officer-in-charge of Kotwali P. S. Rushed to the spot and saw the lootings still going on. The police arrested 11 accused persons on the spot and made a seizure list of the articles in presence of the accused and others, one of them being a civil Court peon.
