O R D E R Adnan-ul-Karim Memon, J Petitioner Ashraf Ali has filed this Constitutional Petition under Article 199 of the Constitution of the Islamic Republic of Pakistan, 1973, seeking release of pensionary and retiral benefits along with claims of retrospective appointment as Physiotherapist (BPS-17) w.e.f. 1996, with consequential seniority and service benefits, re -fixation of pension, and other ancillary reliefs. The petitioner, appearing in person, submits that he served in SESSI since 1984 and retired on 04.12.2018, however, his pensionary benefits were not released. Learned counsel for the respondent -S.E.S.S.I. states that the comp etent authority has sanctioned pensionary benefits in favour of the petitioner, including monthly pension, medical allowance, commuted value of pension and arrears, aggregating to Rs.6,236,490/ -, which has already been paid to the petitioner vide cheque dated 30.03.2026. It is further stated that the amounts on account of L.P.R. encashment and G.P. Fund have also been sanctioned and received by the petitioner. The petitioner, present in Court, acknowledges receipt of the aforesaid amounts, albeit under protest, and contends that his pension has not been fixed on the basis of the post of Physiotherapist. In view of the above, since the principal relief regarding release of pensionary and retiral benefits has already been satisfied, the instant petition does not survive to that extent.

As regards the grievance of the petitioner relating to fixation of pension on the basis of the post of Physiotherapist, the same requires determination by the competent forum/committee of the respondents upon approach by the petitioner. Accordingly, this petition is disposed of with direction to the concerned Committee/competent authority of the respondents to decide the petitioner’s claim regarding fixation of pension on the basis of the post of Physiotherapist, strictly in accordance with law, within a period of three (03) weeks after hearing him.
