Court Name: Lahore High Court Judge(s): Sardar Muhammad Iqbal, Muhammad Siddiq Title: ALLAH DITTA AND Another vs Raja SAEED AKHTAR Case No.: Revision No. 273 of 1970 Date of Judgment:1971-11-30 Reported As: PLD 1973 Lahore 215 Result: Petition dismissed Judgment ORDER SARDAR MUHAMMAD IQBAL, J.-This is a revision petition under section 21 of the Displaced Persons (Land Settlement) Act against the order dated the 29th of June 1970, of the Additional Deputy Commissioner (Consolidation), Gujrat exercis--ing the powers of the Chief Settlement Commissioner whereby he rejected the application of the petitioners under section 11 of the Act. The facts of the case are that Major-General Abdur Rehman had a verified claim for land abandoned by him in Alwar State. He was confirmed on 19th of April 1952 land measuring 744 kanals and 7 marlas in Damoon Chak, Tehsil Kharian, ,District Gujrat. It included some of the land which had been allotted to Jammu and Kashmir refugees temporarily for maintenance. Allah Ditta petitioner No. 1, as a Jammu and Kashmir refugee, was allotted temporarily in lieu of maintenance, land measuring 74 kanals and 13 marlas and Muhammad Din, petitioner No. 2 had been allotted 101 kanals and 2 marlas on the same conditions. There were representations made by the temporary allottees against the allotment but they were not accepted. The Punjab Government in thin behalf addressed a memo.
