O R D E R Adnan-ul-Karim Memon, J. Petitioner Muhammad Riaz has filed the present Constitutional Petition under Article 199 of the Constitution of the Islamic Republic of Pakistan, 1973, seeking cancellation and suspension of allotment order dated 19.12.2025, and declaration of his en titlement to the subject flat. 2. On the first date of the hearing, no one appeared on behalf of the petitioner. It is noted that even on earlier dates, the petitioner remained absent despite opportunities. 3. Learned AAG submits that the petitioner, form erly serving as Assistant to Deputy Commissioner, Korangi, Karachi, was allotted Flat No. 2/4, Block -AB, Jacob Lines Housing Complex on 17.06.2021. He subsequently retired from service on 30.06.2024, whereafter the said flat was allotted to one Ghulam Abba s Shah, an employee of the Culture & Tourism Department. It is further stated that the accommodation is reserved for employees of the Revenue Department, whereas the subsequent allottee belongs to a different department. It is also noted that no complaint was lodged by the petitioner regarding alleged dispossession as portrayed by him. 4. In view of the persistent non -appearance of the petitioner and failure to prosecute the matter, this Court is left with no option but to dismiss the petition in default. H owever, the respondents shall be at liberty to proceed strictly in accordance with law, while affording a reasonable opportunity to him for adjustment of his family in suitable accommodation, subject to all just and legal exceptions.
