O R D E R Adnan-ul-Karim Memon , J Petitioner Khan Mir has invoked the constitutional jurisdiction of this Court under Article 199 of the Constitution of the Islamic Republic of Pakistan, 1973, seeking a declaration and consequential directions regarding the release of his retirement benefits, including gratuity, from the respondent authorities. 2. It is the case of the petitioner that he wa s initially appointed in 1990 as an Ex-Malaria Cooly (BPS -02) in the Karachi Municipal Corporation (KMC) and remained in service until his retirement on 26.03.2020. Despite having duly retired, his pensionary and other post -retirement benefits have not bee n released to date. The petitioner contends that the respondents, being a statutory body, are constitutionally and legally obligated to act in accordance with law and are bound to release such benefits without undue delay, as these constitute his vested an d fundamental rights. 3. On the other hand, learned counsel for the respondents/KMC submits before the Court that the department has no objection to the payment of the petitioner’s retirement benefits. It is further stated that the same shall be released within three weeks, subject to verification of entitlement in accordance with the law. 4. In view of the above statement, the matter is disposed of accordingly, with directions to the respondents to process and release the petitioner’s retirement benefits within the stipulated period.
