A notice was served on the respondents. Their case is that the applicant resigned in the year 1968. The resignation had formed the subject-matter of the pro--ceedings before the Martial Law Authorities and also before the Labour Directorate and letter dated 1st September 1969 from the Martial Law Headquarter Sector No. 1, S. I. T. E. Shows that the resignation had apparently been taken to be in order. According to the respondents after the applicant tenderedl4 his resignation he is not entitled to any benefit. Even so they have agreed to pay him the following amount. (1) contribution to provident fund equal to the amount to the credit of the applicant, in the fund. (2) Rs. 1,000 (Rs. One thousand) less amount already paid as notice pay ex gratia and bonus. Prayer for re-instatement is rejected. The applicant may e collect the above amount after returning the uniform etc. His identity card has been deposited in this Court.
