ORDER Adnan-ul-Karim Memon, J . Petitioner Suresh Kumar has filed this Constitutional Petition under Article 199 of the Constitution of the Islamic Republic of Pakistan, 1973, seeking following relief: - a. To declare that the petitioner is legally entitled for recovery of retirement benefits Gratuity etc. from the respondents and the respondents are bound to act under the framework provided in the Constitution of Pakistan and to obey the law being the statutory body incorporated under the provincial government.
b. To direct the respondents to release retirement benefits Grat uity etc. forthwith without committing any further delay as the respondents being statutory body is bound to act in accordance with law and recovery of dues is the fundamental right of the petitioner and respondent is bound under principle policy to do so.
It is, inter alia, contended on behalf of the petitioner that he was appointed on 02.3.1986 as ex -Malaria Cooly (BPS -02) in the KMC Department and retired on 29.4.2025. Counsel contends that since the petitioner’s retirement, his retirement dues have not yet been paid.
Learned counsel representing the respondent / KMC submits that the department has examined the case of the petitioner so far as his pensionary dues are concerned, the same shall be released in accordance with law subject to his entitled within a period of three weeks’ time.
In view of the above statement of learned counsel for the KMC, learned counsel for the petitioner seeks disposal of this petition, which is accordingly disposed of alongwith pending application(s), if any with dire ctions that the petitioner’s legal dues shall be cleared within three weeks’ time.
