' The facts leading to the filing of the above appeal are that the appellant is owner and landlord of a composite building situated on Plot No,130-C, Maket Area, P.E.C.H.S, Karachi and the respondent No,1 is tenant in respect of a shop at the monthly rental of Rs,200 since 1-5-1970 vide Rent Deed, dated 30-4-1970. The respondent No,1 agreed to pay electricity consumption charges as per reading of sub-meter plus 50 paisa per month towards meter charges. The respondent No,1 also agreed to pay Rs,7 per month on account of water and conservancy charges towards his share of P.E.C.H.S. Bills. The appellant filed Eviction Application No,2251 of 1976 on the ground of surrendering possession of ,shop in question without the written consent of the application violation of the terms of the tenancy and non-payment of water and conservancy charges at the rate of Rs,23 per month.
