Adnan-ul-Karim Memon, J. Petitioner Muhammad Sadiq has invoked the jurisdiction of this Court under Article 199 of the Constitution seeking payment of differential salary based on BPS-17 from 05.05.1993 till his retirement on 07. 01.2015, along with corresponding revised pensionary benefits thereafter, in terms of the order dated 29.03.2023 issued by the competent authority.

2. It is noted that in earlier litigation, the petitioner’s claim for upgradation/selection grade to BPS -17 was accepted as a left -out case and granted vide order dated 29.03.2023. The record reflects that while the Education Department forwarded the matter to the Accountant General’s office, the revised pension case of the petitioner has not yet been formally transmitted for processing.

3. During proceedings, the representative of the Accountant General submitted that upon receipt of the complete revised pension case, the office would examine and process the claim of the petitioner in accordance with law, incl uding consideration of the selection grade period, subject to all lawful exceptions.

4. In view of the foregoing, this Court is of the considered view the petitioner’s grievance primarily relates to the processing of his revised pension case, which requi res formal forwarding by the Education Department to the Accountant General’s office rather than adjudication in constitutional jurisdiction at this stage.

5. Accordingly, with the consent of the parties and without touching the merits of the case, this petition is disposed of with directions to the concerned Department to forward the petitioner’s revised pension case to the Accountant General’s office within four weeks for consideration and decision in accordance with law. Pending applications are also being disposed of.
