The case of the petitioners is that their history-- sheets were opened by respondent No. 2 on the advice of respondent No. 3. The order passed for the opening of the history sheets was challenged in the High Court of West Pakistan in Writ Petition No. 300/60 which dismissed by a Division Bench of the High Court on the 1st June 1961. The petitioners challenged this order in P. S. L. A. No. 230 of 1961 in this Court. Leave was granted to the petitioners and the appeal came up for hearing before this Court on the 12th February 1963. On that date the learned Additional Advocate- General submitted that the impugned history-sheets have been closed. In view of this statement the appeal was dismissed as having become infructuous. The petitioners' allegation is that that they were under the impression that their history-sheets had been closed but petitioner No. 3 was arrested by the police under sections 13 and 14 of the Control of Goondas Ordinance, 1959.
