It is, inter alia, contended by the learned counsel for the petitioners that petitioner No.2 is lawful owner and purchaser of Plot No.548 (Old No.E -407) and Plot No.549 (Old No.E-408), Sheet No.1, Moosa Colony, Gulberg Town, Karachi purchased in 1975 through a lawful agreement; that subsequently on 21.9.2025 , a settlement agreement was executed between petitioner No.2, his four brothers and son Muhammad Ahmed Khan (respondent No.11) of his deceased brother and it was mutually agreed that whenever the said plots are sold, the petitioner shall voluntarily give 50% share of one plot to Jameel Ahmed Khan and 50% share of Plot No.E-407 to Muhammad Ahmed Khan and all brother s expressly raised no objection to this agreemen t. He further contended that respondent No.9 and respondent No.11 alongwith their wives i.e. respondent No.10 and respondent No.12 became greedy and dishonest and took illegal assistance from the police officials (respondents No.7 and 8) and forcibly dispo ssessed the petitioners from the said plot on 25.10.2025. He further contended that the petitioners submitted complaint to the SHO Police Station Gulberg alongwith respondents No.2 to 5 requesting registration of FIR and to take action against the culprits. Today, learned Assistant PG submits that the FIR No.520 of 2025 has been registered in PS Gulberg District Central, Karachi under Section 324/448/34 PPC. The purpose of filing this petition prima facie is served, therefore, no further action on the part of this Court required. However, it is made clear that no harassment shall be caused to either party by the police, who shall be neutral in the private affairs. If there is a criminal / civil litigation between the parties, the same shall be taken care of by the competent Court of law. Petition stands disposed of in the above terms alongwith listed application.
